Handling of Personal Information of People Residing and Staying in Kingdom of Thailand

Our Group will comply with applicable laws and regulations of the Kingdom of Thailand, appropriately handle personal information of those residing and staying in the Kingdom of Thailand, and strive to protect their privacy.

In addition to the body of this Policy, the provisions of Schedule 3 shall apply to the handling of personal information of persons residing and staying in the Kingdom of Thailand. In the event any of the provisions of the body of this Policy conflict with those stipulated in Schedule 3, the provisions of Schedule 3 shall prevail.

Personal Information to be Handled

When the provision of personal information is required under law or contract or is a requirement necessary to enter into a contract, Owner is required to provide the relevant personal information. However, Owner’s provision of personal information on Our Group’s website is not a statutory or contractual requirement, or a requirement necessary to enter into a contract, as well as Owner is not required to provide the personal information. Please note that the failure to provide such personal information may cause difficulty in providing products/services Owner may request.

Disclosure of Personal Information to Third Parties

Our Group may disclose personal information to Our Group companies within the extent of the purposes of processing.

Transfer of Personal Information to Other Countries

If it is necessary for Our Group to transfer or provide personal information to other countries, Our Group will ensure that;

  1. The destination country that receives such personal information has adequate data protection standards as required by law and the data transfers to such destination country are carried out in accordance with the rules for protection under Personal Data Protection Act in Thailand (“PDPA”).
  2. Our Group will provide suitable protection measures that enable the enforcement of Owner’s rights, including effective legal remedial measures according to the applicable privacy laws and regulations in force from time to time.
  3. Our Group shall comply with other applicable provisions of the PDPA when transferring.

Owner’s Rights

With respect to personal information collected, used, or processed under this Policy, the Owner is entitled to exercise the rights in accordance with the PDPA and other applicable regulations, which can be summarized, as follows:

  • Rights of access
    Owner has the right to request access or obtain a copy of Owner’s personal information or to request the disclosure of the acquisition of Owner’s personal information obtained without Owner’s consent, unless there is a restriction under law or pursuant to a court order, and such access and obtaining of the copy of personal information would adversely affect the rights and freedoms of others.
  • Rights to withdraw consent
    In the event that Our Group relies on Owner’s consent to collect, use, process or disclose Owner’s personal information, Owner may withdraw the consent at any time, unless there is a restriction on the withdrawal of consent under law, or the contract which grants benefits to Owner.
    However, the withdrawal of consent shall not affect the collection, use, processing or disclosure of personal information for which Owner has already given consent legally.
  • Rights to rectification
    Owner has the right to request the rectification of Owner’s personal information if it is incorrect and to ensure that Owner’s personal information is accurate, up-to-date, complete, and not misleading.
  • Rights to object
    Owner has the right to object to the collection, use, processing or disclosure of Owner’s personal information by Our Group, in accordance with the terms and conditions under the PDPA.
  • Right to restrict
    Owner has the right to request to restrict the use of Owner’s personal information, in accordance with the conditions under the PDPA.
  • Right to portability
    In certain circumstances, Owner has the right to receive Owner’s personal information from Our Group, in the format which is readable or commonly used by ways of automatic tools or equipment and can be used or disclosed by automated means.
  • Right to erasure
    In accordance with the conditions provided under the PDPA, Owner has the right to request Our Group to erase, destroy, or anonymize Owner’s personal information so that this personal information cannot identify Owner.
  • Right to file a complaint
    Owner has the right to lodge a complaint with the relevant authorities for any violation or non-compliance under the PDPA, its regulations and notifications, in relation to Owner’s personal information including but not limited to the Office of the Personal Data Protection Commission.

In addition, we may however continue to collect use, process or disclose Owner’s personal information on other legal basis(es) under the PDPA, as applicable.

Owner may request Our Group to send or transfer Owner’s personal information in such formats to other data controllers if it can be done by automatic means and Owner may also request to directly obtain Owner’s personal information in the same format as used by Our Group to send or transfer Owner’s personal information to other data controllers, unless it is impossible to do so because of technical circumstances.

Our Group will provide contact information for Owner to submit a request to exercise Owner’s rights. Our Group reserves the right to deny Owner’s request based on the provisions of the PDPA. In the event that our Group denies Owner’s request, our Group will inform Owner of the reason for the refusal. Owner will have the recourse rights provided under the PDPA.
